Refusal to assess or issue appeals
If your local authority has refused to assess your child for an Education, Health, and Care Plan (EHCP), and you believe they should conduct an assessment, you have the right to appeal their decision. This is an appeal we can support you with. Similarly, if the local authority, after the needs assessment, decides not to issue an EHCP, you can appeal at this stage, too, and we could offer you support.
Contents and placement appeal
You may believe that the support and provisions outlined in the EHCP are insufficient to meet your child's needs effectively. This could include concerns about the level of provision, therapies, or additional support support specified in the plan.
You may disagree with the assessments conducted by the local authority, which form the basis of the EHCP. If you believe that the assessments do not accurately reflect your child's needs, it can be a valid reason for an appeal.
If you believe that certain needs or requirements of your child have been overlooked or omitted from the EHCP, you may appeal to ensure that all necessary provisions are included. Section B should contain all of your child's special educational needs.
You may disagree with the school or educational placement named in section I of the EHCP. If you have a preferred school or placement that you feel would better meet your child's needs, you can appeal to have it considered.
